Message of Mr. Francis Deng, Special Adviser of the United Nations
Secretary-General on the Prevention of Genocide on the Sixtieth Anniversary of
the Convention on the Prevention and Punishment of the Crime of Genocide.
Preventing genocide, sixty years later
On 9 December 1948 the United Nations adopted the Convention on the Prevention
and Punishment of the Crime of Genocide. The term ‘genocide’ was first coined
by Rafael Lemkin. It is derived from the Greek word genos, roughly meaning
family origin, ancestry, but also species, tribe or race, and the Latin-derived
suffix cide – to kill. Lemkin’s vision was to capture in one word this type of
murder, and have it recognized as an international crime. In his days massacres
were still viewed as actions of a sovereign state, not to be interfered with by
international law. The Convention was largely the result of Lemkin’s vision and
work.
The Genocide Convention has a very specific focus: it defines the crime as a
number of specific acts, including killing with intent to destroy, in whole or
in part, a national, ethnic, racial or religious group. It compels signatory
states not only to punish, but also to prevent genocide. The Convention
stipulates that not only genocide, but also conspiracy to commit genocide,
direct and public incitement to genocide, and attempt to commit genocide are
punishable as well. It also provides the UN Security Council with a basis to
act in order to prevent and suppress genocide.
Punishment requires a legal determination by a court of law as to whether
genocide has in fact occurred. The special tribunals established for the Former
Yugoslavia and Rwanda did indeed proceed to prosecute the perpetrators of
genocide in both places. The International Criminal Court, established in 1998,
now has general jurisdiction for the punishment of perpetrators of genocide
from countries that recognize the Court’s authority.
As far as prevention is concerned, scholars have repeatedly pointed out that
genocide can be predicted, and that ‘early warning’ signs exist, and for
instance include hate speech combined with organizing and arming groups.
However, many believe that it is impossible to prevent genocide: not because
information on the signs of an impending genocide is missing, nor because the
UN and others are not aware of them, but because the international community
has been reluctant to acknowledge that genocide may occur. Doing so can
complicate diplomatic relations, and, more importantly, raise the expectation
that something forceful needs to be done by the international community, most
notably the Security Council. One of the immense challenges in preventing
genocide is precisely that the term itself is so powerful – it is vital that we
use it early and firmly when appropriate, but also important that the term not
be abused for political or other gain.
The current situation in the Democratic Republic of the Congo is one of many
around the world, which requires us to remain constantly vigilant: The conflict
in the eastern part of the country takes place in a region with a history of
genocide. Atrocities are being committed every day, despite a significant UN
peacekeeping presence there.
So how do we, as citizens of the world, break this vicious circle of violence,
denial, insufficient response, public outrage at the inaction and impunity?
One thing we can do is to become aware that certain types of behavior, such as
portraying certain ethnic or racial or religious groups as unworthy,
undesirable, inferior or dangerous amount to playing with fire, a kind of fire
that is very difficult to put out once it starts.
The second is for every one to become more alert to the kinds of behavior that
foment tensions and spark genocide not only when they affect us, but when they
affect others (be it our neighbor or a country far away), and to demand from
those in power an early response. Genocidal killings in one neighborhood spill
fast to the next one, engulfing not only entire countries, but entire
regions. We cannot afford complacency in the twenty-first century.
The third is to continue lending our support and opening our homes to the
victims of genocide. If we have failed to prevent terrible things, at least let
us do all we can to ensure that as many as possible are saved. Governments have
an obligation to protect refugees fleeing genocide and other mass atrocities,
but how fully they embrace those obligations depends on ‘public opinion’, that
is, on every one of us.
We also must support those who are trying to turn the tide in a country, often
at great personal cost. Sometimes we are so occupied with going after the
perpetrators that we forget supporting the moderate voices within a government,
or the members of civil society who could make a difference, yet are often
isolated and weak.
Last but not least, we must demand an end to impunity. We must encourage
governments to accept the jurisdiction of the International Criminal Court.
Governments must also accede to the Genocide Convention. So far only one
hundred and fifty one states (out of the one hundred and ninety two member
states of the UN) have done so. Perpetrators of genocide must never be allowed
to sleep in peace.
All too often, we talk about genocide long after it has occurred. Yet, clearly
genocide is not a thing of the past. We need to acknowledge the cleavages
between different ethnic, racial and religious groups when they are deepening –
and ensure that we manage differences constructively. Sixty years after the
Genocide Convention was adopted, we need to remain vigilant and prepared to
stop genocide.

The International Community on Genocide
Genocide is acknowledged by the international community as a capital crime
against humanity. This is supported by the following documents which the
Russian Federation, as legal successor to the USSR, obliged to follow:
Resolution 260 A (III) of the UN General Assembly “CONVENTION ON THE PREVENTION
AND PUNISHMENT OF THE CRIME OF GENOCIDE” dated December 9, 1948 which came into
force on January 12, 1951 (came into force for the USSR on August 1, 1954);
Resolution 2391 (XXIII) of the UN General Assembly “CONVENTION ON THE
NON-APPLICABILITY OF STATUTORY LIMITATIONS TO WAR CRIMES AND CRIMES AGAINST
HUMANITY” dated November 26, 1968. In particular, Resolution 260 A (III) says: The
Contracting Parties (including Russia which acknowledged the «CONVENTION ON THE
PREVENTION AND PUNISHMENT OF THE CRIME OF GENOCIDE»)…recognizing that at all
periods of history genocide has inflicted great losses on humanity, and being
convinced that, in order to liberate mankind from such an odious scourge,
international co-operation is required, hereby agree as hereinafter provided:
Article 1. The Contracting Parties confirm that genocide, whether committed in
time of peace or in time of war, is a crime under international law which they
undertake to prevent and to punish.
Article II: In the present Convention, genocide means any of the following acts
committed with intent to destroy, in whole or in part, a national, ethnical,
racial or religious group, as such:
(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring
about its physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.
Article III: The following acts shall be punishable:
(a) Genocide;
(b) Conspiracy to commit genocide;
(c) Direct and public incitement to commit genocide;
(d) Attempt to commit genocide;
(e) Complicity in genocide.
Article IV: Persons committing genocide or any of the other acts enumerated in
article III shall be punished, whether they are constitutionally responsible
rulers, public officials or private individuals.
Resolution 2391 (XXIII) of the UN General Assembly “CONVENTION ON THE
NON-APPLICABILITY OF STATUTORY LIMITATIONS TO WAR CRIMES AND CRIMES AGAINST
HUMANITY” dated November 26, 1968 says:
Article I. No statutory limitations shall apply to the following crimes,
irrespective of the date of their commission:
… inhuman acts resulting from the policy of apartheid, and the crime of
genocide as defined in the 1948 Convention on the Prevention and Punishment of
the Crime of Genocide, even if such acts do not constitute a violation of the
domestic law of the country in which they were committed.
Article II. If any of the crimes mentioned in article I is committed, the
provisions of the Convention shall apply to representatives of the State
authority and private individuals who, as principles or accomplices,
participate in or who directly incite others to the commission of any of those
crimes, or who conspire to commit them, irrespective of the degree of
completion, and to representatives of the State authority who tolerate their
commission.
Article III. The State Parties to the present Convention undertake to adopt all
necessary domestic measures or otherwise with a view to making possible the
extradition in accordance with international law, of the persons referred to in
article II of this Convention.
What facts allow to qualify the processes taking place in Russia during
democratic “reforms” as genocide, genocide of ethnical Russians? Such facts
exist and they are irrefutable.
Even the official statistics show that during the period of reforms 10 million
Russians fell victims to genocide
The latest census figures clearly show the following: in 1989 the population of
Russia was 147mln. 022 thousand people. By 2002 this number dropped down to
145mln. 167 thousand people, with this the number of ethnical Russians in the
RF reduced from 119 870 thousand to 115 870 people. These figures, however, do
not reflect the decrease of Russians in the RF in full since they do not
account for the number of Russians who migrated into the country compared to
those who left the country. However even at this early stage the “intention to
destroy (so far partially) members of one national group” – ethnical Russians
is clearly seen. With this the decline in number of censured Russians gives
enough ground to begin an investigation on the fact of genocide: the figures of
decline in the number of ethnical Russians namely are threatening. 15 other
large nationalities of which there are Tartars, Bashkirians, Chechens,
Armenians, Kazakhs, Azerbaijanis, Kabardinians, Osetians, Darginians, Byuryats,
Yakyuts, Kyumiks, Ingushis, Lezgins, - during the same time period increased
their numbers. Ethnical Russians losses include the balance between 11 mln.
Russians who left the country and 5.4 mln. people who came to Russia
(Goskomstat – (the State Statistical Committee) - census figures). The total
losses of ethnical Russians with this make (according to official data alone)
over 8 mln. people! THIS WAS RECOGNIZED BY GOSKOMSTAT in the following wording
which in fact exposes the character of the present regime (see Goskomstat site
www.gks.ru): “the share (of ethnical Russians) in the total population of
Russia dropped down by 1.7 percent. This happened mostly due to a natural loss
of 8 mln. people, which was not compensated by slightly more than 3 mln.
ethnical Russians that migrated into the country” (the loss of 8 mln. people
belonging to one of many nationalities can not, at time of peace, be “natural”
– ie. it is genocide). To summarize: according to official statistics alone
ethnical Russians lost 8 mln. people during 1989-2002.
Since the loss of population during recent years was no less than 1 mln. men
per year, this means that no less than 10 mln. ethnical Russians were killed by
the ”reformers” in between 1989 to 2004!!!
In reality the losses of Russians are much greater because the census was
conducted unscientifically and in a way discriminate to Russians (to hide, at
least in part, the ethnical Russians demographic catastrophe?). Here is how the
Goskomstat site tells about this “method”: “The national identity during the
census was stated according to the Russian Federation Constitution by the
interviewed people themselves on the basis of self-determination and was
written down by interviewers strictly by the words of the interviewed”. This is
how one can run a census of those who want to be Russians since it is
impossible to award oneself a nationality solely on one’s own will.
The mortality rate in 26 central Russian regions exceeds the birth rate by 2-3
times. At the same time the birth rate in “non-Russian” regions, on the
contrary, exceeds the death rate. Entire regions in Siberia and the Far East as
well as many village areas in the North and Central part of Russia became
deserted. For known reasons the life expectancy in the country is declining
especially among men. If these trends continue the indigenous population of
Russia – ethnical Russians – in 50 years will drop down two times! Here are
horrible figures from the Goskomstat official site (article “Results of the
2002 All-Russia Census”): “During the period in between the censuses the number
of people over the working age increased by 2.6 mln. people (by 9.5%). At the
same time the number of children and teenagers during the same time period
dropped down by 9.7 mln. people (by 27%). The sharpest reduction (by 43%)
occurred in the age group of children under 10 years old (the generation born
in the past decade when the birth rate was the lowest during the entire
post-war history of Russia)”.
There are other dismal figures. V.V.Kozhinov, for example, in his work “On the
results of the recent elections” (the book “The Victories and Troubles of
Russia”, M.2002) with the use of strict mathematical methods argues that “most
likely the losses of adult population in the 1990-s are over 20 mln. people…”
Other scholars also state the figure of Russian losses during the previous
decade as 20 mln. people.
Specialists-demographers (in particular V.Bashlachyov) forecast the total
disappearance of Russians during the XXI century if the current trends prevail.
Scientists introduced a term “Russian cross” which is the intersection of the
declining line of birth rate with the growing line of mortality rate. The
destruction, the genocide of Russians was caused by the “reforms” of the 90-s.
Thus, for example, in “The White Book. Economic reforms in Russia during
1991-2002” (S.Glazyev, S.Kara-Murza, S.Batchikov; M., 2004) based on official
irrefutable statistics the following strong conclusions are drawn: “…it is
precisely a demographic catastrophe that is taking place during the current
reforms”, p.21; “The demographic havoc is a direct result of the reform” p.23;
“It is necessary to point out the mortality surge which started in the RF after
1998 with a new round of reforms”. P.23.The “black privatization” by the
estimate of scientist V.Lisichkin was one of the greatest crimes of the XX
century which robbed and deprived primarily the ethnical Russians of the means
to existence (V.A.Lisichkin, L.A.Shelepin “Russia Under the Power of
Plutocracy”, M., “Algorithm”, 2003).
Filicide
Let us look into the following marks of genocide – “imposing measures intended
to prevent births within the group”, “deliberately inflicting on the group
conditions of life calculated to bring about its physical destruction in whole
or in part”. The present cannibal regime eliminates in the first place the
future of ethnical Russians and Russia at large – the children and youth. The
figures and facts that the readers will now learn are kept away from the public
and are not voiced in news programs. According to various calculations there
are from 5 to 8 mln. homeless children in the RF (newspaper “Sovetskaya
Rossiya”, February 5, 2004) who do not work or study and make their living by
begging, stealing, selling drugs, prostitution. Poverty and despair forces many
mothers to push their 8-15 year old daughters on this path. Russia is the
leader on the market of child pornography distributed on the Web, the country
is turned into a dump pile and seed bed of children sexual exploitation which
is a result of mass homelessness and social ill-being in the families.
The case of the “Blue Orchid” pornographic site became widely known across the
world. The site was set up in Russia, Moscow and sold children pornography to
Europe and the USA showing scenes of sexual torture and murder of underage
children. The main persons found guilty and convicted on the “Blue Orchid” case
are Russia citizens who were arrested in Moscow – Solntsev-Erbe and Kyuznetsov,
- these two criminals were released from jail on amnesty. Over 50 000 slaves
from Russia are annually supplied to slave markets of the USA alone where they
are subjected to sexual exploitation.
Finally, during the past 10 years 7 mln. children in Russia died from different
diseases (data for 2002 reported by the RF Ministry of Health press-service).
According to other data this astonishing number will reach 10 mln. in 2004. An
independent survey by the “Russian Children’s Fund” headed by Albert Likhanov,
showed that the number of children and teenagers in Russia reduced since 1992
by 14 mln. 30 thousand kids annually disappear in Russia and 2 thousand commit
suicide. Along with this specialists have registered a growth of the incidence
rate for all classes of sicknesses forming chronic pathology. In particular,
the number of cases of children and teenagers lung diseases grew by more than
one third, the number of illnesses of the digestive tract grew up by 50%. The
increase in the neuropathy cases is 15% for children and 23% for teenagers. The
deterioration of the psychical health of children of the juvenile age as well
as the consumption of psychoactive substances (drugs, toxicants, alcohol)
remain a sharp medical-social problem. The number of kids with diabetes in the
past 10 years increased by 80% and now makes over 17 thousand children.

"In Russia the RVF’s vaccination initiative
against hepatitis B, a catch-up vaccination strategy targeting adolescents,
orphans and at-risk health care workers, reached nearly 2 million individuals
during the period from 2000-2006. Now this vaccination initiative against
hepatitis B is being financed and managed entirely by the Russian Ministry of
Health and Social Welfare"

By the results of the 2002 health survey the number of incapacitated kids
reached more than 617 thousand people. The incidence rate according to the RF
Ministry of Health was 42.5% for kids and 64% for teenagers. High incidence
rate and disability reduce the opportunity for children to obtain valid
education, choose a profession and reduces the suitability of youth for
military service.
Despite certain improvements in the obstetrics service, a decline in the state
of health of the pregnant, and an increase in the number of complications
during pregnancy, child delivery and the puerperal period are observed. In the
past 10 years the number of pregnant women with anemia grew up more than 6
times, the incidence of kidney sicknesses, cardiovascular diseases also grew
up. The number of pregnant women suffering from late gestosis rose by 40%.
The rate of normal deliveries declined and their share in 2002 dropped down to
33.1%. The number of AIDS infected pregnant women is rising and reached 3353 in
2002, the number of infants born to AIDS-infected mothers grew up by two times
(in 2001 – 1939, in 2002 – 4523). According to official statistics the general
morbidity among the newborn in the past years increased by 32.3%. 39% of the
newborn had perinatal pathology (all data are taken from the EXPLANATORY NOTE
TO ORDER ¹ 506/9224.10.2003 issued to a program “On the measures of improving
the state of health of the Russian Federation children for years 2003-2010 (by
results of the 2002 All-Russia medical survey of children))”.
Fetal therapy is “being developed” in the RF. Fetal therapy means preparation
of very expensive “rejuvenating” medicines from the organs of aborted fetus.
This is practiced by RAPS – Russian Association for Family Planning created on
the money of Soros. For more than 10 years 300 RAPS centers in Russia have
openly and under the disguise of a struggle with abortions and “sexual
enlightenment” been implementing programs on birth reduction which includes
sterilization. The activities of RAPS, which psychologists I.Medvedeva and
T.Shishova characterize as “planning of non-existence”, directly match the
notion of genocide – “measures directed at preventing childbearing”.
The count of abortions (murders) reached millions. Out of 10 pregnancies 7 end
up with abortions. This was assisted by a decree signed by prime-minister
Chernomyrdin in 1997 containing a list of “social indications” according to
which women are allowed to do an abortion even on the 22 week of pregnancy when
a child may quite possible be born alive! The majority of women are covered by
that list. The number of medical indications for sterilization was also
increased.
According to the data of the General Prosecutor’s office, the Ministry of
Internal Affairs and the State Statistics Committee of the RF the child
mortality rate in Russia is three times higher than in Western Europe. How many
future would-be Tsiolkovskiy, Mendeleyev, Vernadskiy, Chizhevskiy, Yesenin did
Russia lose? F.M.Dostoyevskiy warning that “we will choke to death any genius
in the cradle” expressed in his novel “The Devils” came true. And indeed
children are choked, killed, turned into drunkards and drug abusers destroying
our gene pool.
With this one and a half million children in the RF do not attend school or
work, 600 thousand kids annually lose one of their parents and 300 thousand are
born out of wedlock. According to Goskomstat the number of mentally-retarded
children in Russia in the past 10 years grew up 20 times and around one million
are incapacitated and are registered in various dispensaries. The RASA news
agency informs: according to data of the RF Ministry of Health 1013 thousand
newborn infants are abandoned by their mothers annually.
According to the Ministry of Internal Affairs figures more than 15 thousand
children of the age from one month to five years are taken outside the country
annually. At least one fourth of the children adopted by foreign citizens are
later used as donors for transplanting organs, skin and tissue. After the
operation the child is usually disposed of without leaving traces of his
presence in the country. The “contractors” pay from 50 to 100 thousand dollars
for one newborn.
Here are the figures for one of the years of “reforms”: in 1996 17 thousand
infringements on children life were registered, 200 children were killed by
their mothers, one and a half thousand were subjected to sexual violence, two
thousand committed suicide. The number of children involved in porno business
increased by 12 times, 10 thousand drug related crimes were committed, every
fourth teenager committed a crime in a state of alcoholic intoxication. During
the previous year out of one thousand newborn in Russia 17 died during their
first year of life which is 3-4 times higher than in the countries of Europe.
90 % of young Russians suffer from hypovitaminosis, scabies rate increased 4
times compared to 1992, syphilis rose up 20 times. V.Smolentsev in his article
“Disastrous path of the government” (newspaper “Zavtra”, ¹36, 2003) gives the
following statistics: teenagers today start to drink from 11, to smoke -from
10, take drugs - from 12 years old. Demographers inform: Russia has practically
lost its young generation. In the past 10 years teenagers started to kill 3
times more often. Every fourth Russian conscript is a drug addict. In the
period from 1990 to 2001 the average age of kids just starting to smoke reduced
from 15.2 to 10.1 years old.
81.8% of young men recognize that they drink alcohol beverages this or that
often. 75.9% drink bear (approximately equally young men and women). 41.5% of
young men and 24.2% of girls drink vodka, with this 45% of working teenagers,
technical colleges students, the unemployed and those who do not attend any
classes drink vodka. Spirits and moonshine is preferred by 11% of boys and 5.1%
of girls. Wine is drunk by 36.7% of girls and 19.4% of boys. During the period
of reforms the prices for vodka grew up 10 times slower than on other
foodstuffs. The advertisements of bear on TV, radio, in the newspapers and on
posters is very massive which is especially dangerous because it introduces
into the teenagers conscience that bear is a “non-alcoholic, safe product”. The
spread of alcoholism among the young generation damages the gene pool of
Russians.
The Head of the State Committee on Drug Control reports that the number of drug
addicts reached 3.5 mln. people. According to him: “The rate of the drug
addiction spread has no precedents in the world history”. On May 14, 2004 a
Government Provision (¹231 dated May 5, 2004) allowing to carry up to 1 gram of
hard drugs, including heroine, came into force. The appeal “Lawful genocide!”,
adopted at a meeting of alcohol abstainers organizations of Russia says: “The
Government provision makes the drug epidemic irreversible. This is one more
witness of genocide against the Russian people” (newspaper “Znaniye-Vlast”, ¹27
(194), July 2004).
Now we come to “acts committed with intent to destroy, in whole or in part, a
national, ethnical, racial or religious group, as such” which actually is the
notion of genocide. The “Leningradskaya Pravda” issue ¹5, 2004 published a
speech “Meet the challenges of today” by Yu.K.Kovalchyuk, academician of the
Petrovskaya Academy of Sciences and Arts. This speech clearly shows acts,
namely the INTRODUCTION OF THE USA COLONIAL PROGRAMS, directed at the
DESTRUCTION under the disguise of “reforms” of the agricultural and food
sectors of the former USSR economy, which are implemented through bodies of
power formed by the USA in the RF.
A scientific assessment of the introduction of these “programs” showed a
tremendous damage which led to the reduction of the level of food consumption
in Russia to 2200 kcal., which is below the physiologically accepted level. This
actually is an organized famine, which is one of the components of demographic
terror directed against Russians. A clear act of genocide was the shooting of
the White House (building of the Government of the RF – translators note) in
October 1993.
THERE ARE 35 MILLION ILLEGAL IMMIGRANTS IN THE COUNTRY
The recently adopted laws in the Russian Federation related to the social
sphere, abolition of benefits (called “monetization” with the purpose of
concealing the truth) are regarded by the wide public in Russia as destructing
the social legislation. In 155 legislative acts the main civil rights
protecting norms are breached. The appeal of the members of the State Duma
Committee on Education and Science “Lawful havoc” notes that 22 mln. families
will lose any hope for the increase of children benefits. In many regions there
also is no hope for their timely payment; 10.5 mln. incapacitated, almost one
million disabled veterans and one hundred thousand participants of the Great
Patriotic War will lose their social benefits to get obviously insufficient
monetary compensations; impecunious children will stay home during their
vacations because their parents will lack the means for a trip outside; the
fees for kindergartens and nurseries are increased, the number of children
attending schools and the level of their pre-school preparation is dropping down.
In their address to the world public “Say “No” to the abolition of social
guarantees!” representatives of the largest public organizations of Russia
point out the danger of the RF Government plans to reform the social sphere.
The realization of these plans will lead to the disruption of the existing
social services system and a “drastic drop in the standards of living of the
absolute majority of the country’s population” (one of the indicators of
genocide related to the ethnical Russians majority).
The appeal “Say “No” to the abolition of social guarantees” published in the
“Nasha Solidarnost” newspaper was signed by: the Trade Union Federation of
Russia, All-Russia Confederation of Labor, All-Russia Society of the
Incapacitated, “Socialist Resistance” movement, Federal Trade Union of Air
Traffic Controllers, Trade Union of Aeronautical Radiolocation,
Radio-navigation and Telecommunication Employees, the “Protection of Labor”
Association of Worker’s Trade Unions, Interregional Trade Unions Association
“Solidarnost”, Confederation of labor “Kyuzbass”, Novosibirsk Trade Unions
Center, Uralprofcenter, Tyumenprofcenter, Yaroslav Confederation of Labor, the
VAZ car manufacturing plant Trade Union “Yedinstvo”, Workers Academy
Foundation, Voronezh Committee of United Actions, Astrakhan Council of Public
Solidarity, Leningrad Committee of United Actions, Moscow Division of the
All-Russia Organization of Veterans (pensioners) of War, Labor, Armed Forces
and Law Enforcement Bodies, the Moscow Region Division of the All-Russia
Organization of Veterans (pensioners) of War, Labor, Armed Forces and Law
Enforcement Bodies.
The recently introduced Housing code (developed by the “United Russia” State
Duma faction) will bereave and give the key of the street to new victims of
today’s Russia due to the increase in the payment of housing and utility
services.
RACIAL DISCRIMINATION OF ETHNICAL RUSSIANS
It is very important to stress that ethnical Russians are the discriminated and
oppressed majority of the Russian Federation with regard to the protection of
civil and political rights. Framework international acts by which the states
guide their policy (in particular the UN General Assembly Resolution 2200 A
(XXI) “INTERNATIONAL PACT ON CIVIL AND POLITICAL RIGHTS” dated December 16,
1966) give every people a sacred right to self-determination and free choice of
political status, and underlines that “no people in no case well be deprived
the means of existence belonging to it”.
21 ethnos in the RF self-determined into 21 republics built on
national-ethnical grounds. These national states have their own Constitution,
citizenship, President, power bodies. None of the Constitutions of these states
contain any words on the rights of ethnical Russians, though in 14 out of 21 republics
ethnical Russians constitute the majority. This way ethnical Russians turned
out to be the only people who did not realize their right to self-determination
within the boundaries of the Russian Federation. This in fact is discrimination
and is a legal “support” of genocide which is going on. 21 ethnos has double
protection – All-Russia nationhood and a national one, and ethnical Russians
have All-Russian nationhood only.
This breaches article 5, part 3 of the RF Constitution which deals with the
“equality and self-determination of the peoples of the Russian Federation”.
With this the Russian people, being the backbone of the RF turned out in a
situation when, according to the current Constitution of the RF, the Russian
Federation is not a state of ethnical Russians – its entire “multinational
people” is acknowledged as the subject of power. According to international
practice Russia, however, is a mono-national, one nation state. The important
conclusion with regard to the above mentioned is as follows: to demand the
implementation of a right to self-determination of ethnical Russians in a
Russian national state actually means to implement the current RF Constitution
which is the principal law and for this reason means to protect the
institutional framework!
The RF passports lack the “nationality” graph. According to art.26, part 1
“Every citizen has a right to determine and state his national identity”: this
means that ethnical Russians as a nationality according to the current RF
legislation are subjects of neither international nor internal Russian
legislation. The absence of self-determination of the Russian people within the
limits of the entire Russian Federation breaches one of the fundamental civil
rights (see the UN Resolution 41/128 “DECLARATION ON THE RIGH TO DEVELOPMENT”
dated December 4, 1986) – the right to development. In this case
self-determination foresees the creation of adequate legal institutions
including, possibly, a national state (with the observance of the equality of
rights with 21 peoples of the RF which created their own national states
implementing their rights for self-determination) with a Russian Constitution,
institutes of citizenship and Presidency, separation of authority with the
Russian Federation which will ensure fixing the right of the Russian people to
be adequately presented in all federal and local bodies of power (observing the
fair principle of national-proportional representation), as well as the right
to have, high and low, equal rights with other peoples to land and natural
resources according to art.9 of the RF Constitution.
Art. 1, Part 2 of the above mentioned document says: the right of a man to
development presumes also the implementation in full of the right of peoples to
self-determination which includes, pursuant to relative statements of both the
International pacts on civil rights, the implementation of their inalienable
right to complete sovereignty over their natural riches and resources. Ethnical
Russians in the Russian Federation are no subjects of the law. All
organizations, created to voice and protect the rights of the Russian nation at
the federal level were banned by the RF regime. The latest example is the
canceling of the registration of the National Statehood Party of Russia (NSPR).
The clause on stirring up national hatred is applied mostly to the editors of
Russian nationalist newspapers. A many years old law suit against Yu.T.Shyutov
who was twice duly elected to the legislative assembly of Saint-Petersburg and
who now is in a desperate physical condition is still going on with serious
breaches of the norms of international and internal law.
For more than 5 years the voters of one of the districts of Saint-Petersburg
who elected Yu.T.Shyutov to the Legislative Assembly are being deprived the
opportunity to adequate protection of their rights since Yu.T.Shyutov is locked
in jail without a verdict. It is well known in Saint-Petersburg that
Yu.T.Shyutov was impleaded for his exposure of corruption at the upper levels
of power in Saint-Petersburg and the country at large.
The generally acknowledged acts of genocide include the following: 1)
Holocaust, 1938-1945; 2) genocide of Armenians by Turks – 1 500 000 victims,
1915-1918; 3) Rwanda – 800 000 victims, 1994; 4) genocide carried out by Pol
Pot and the “Red Khmers” in Cambodia – 2 000 000 victims, 1975-1979.
Comparative analysis of losses shows that the genocide of Russians, carried out
by “demo-reformers” outmatches in scale and possible consequences (total
extinction of Russians as a people) all known examples in the world history
(the loss of Russian lives during the Second World War – around 20 million -
should also be taken in mind). In all these cases the necessary prerequisite
for acknowledging the fact of genocide was the joint effort of the nation’s
general public, scientists, prominent representatives of culture, civil rights
workers in their attempt to bring to the attention of the world mass media,
governments of various countries of the world, the European community, the Council
of Europe, the UN, UNESCO, PACE and others – the irrefutable facts and
testimony of genocide with a demand to recognize the fact of genocide and
provide help in overcoming its consequences.
After the world public recognizes the fact of genocide the next step will be to
open financial law suits and arrange for international sanctions against those
who are guilty of the genocide. Ethnical Russians saved the world against the
“Brown plague” and now it is the turn of the world community to help ethnical Russians
out of their misfortune. Russian civil rights workers, including scientists of
the city on the Neva river will work along this algorithm.

Protocol ¹1, dated October 14, 2004
On the consequences of implementation by the Leningrad oblast Government of a
free market economy model and the refusal to follow Federal Laws of the RF on
the regulation of the agricultural and food market.
As a result of transfer in the past decade to a free market economy and putting
all stakes on import of food from abroad a state of emergency occurred in
Saint-Petersburg and the Leningrad Oblast. The share of foreign, often low
quality and potentially hazardous to health foodstuffs in the overall turnover
of food in Saint-Petersburg reached 80% which is 5 times above the norm of food
security.
Agricultural production in the oblast dropped down by two times. The
consumption of food dropped below the physiologically acceptable level (milk
from 451 kgs. per person per year to 216 kgs. while the physiological norm is
405 kgs.; meat consumption dropped correspondingly from 93 to 42 kgs. while the
norm is 82 kgs.), the average annual reduction of population reached 60
thousand people. It is possible to make an explicit conclusion today that by
putting stakes on the import of food and liberalization of the food market
along the US Program “Strategy of reforms in the food and agricultural sectors
of the economy…Program of measures for the transition period” an economic
mechanism for realizing a demographic collapse in the region is created.
To restore production and consumption of food according to medical norms and
overcome the demographic collapse the “Proposals on restoring the goods
production in insolvent agricultural enterprises” were developed within the
framework of the Leningrad regional 3-party commission (LOTC) and submitted for
implementation to the Government of the Leningradskaya Oblast.
These proposals envisage according to Federal Laws (FZ) on state regulation of
agricultural production a transition to a regulated market model and forming of
a mixed economy on the basis of a Constitutional position on the equality of
all forms of ownership and economic activities. Regional laws (RZ) “On state
regulation of agricultural/industrial production in Saint-Petersburg and the
Leningradskaya Oblast” were developed and submitted to the Governments and
State legislative assemblies with the purpose of introducing Federal Laws norms
in the region (according to the Constitution art. 72 on issues of joint
competence).
Forming of a regulated market legal framework in the region is necessary to
restore financial self–sustainability of agricultural enterprises by way of
eliminating the disparity of prices and stopping illegal withdrawal of revenues
from agricultural enterprises. Experts estimated that the “Proposals” may be
implemented while transferring to a regulated market within 2-3 years and have
submitted an “Open letter” to the President’s Authorized Representative in the
North-West Federal Okryug and Governors of Saint-Petersburg and the Leningrad
Oblast in which they presented a list of priority means to overcome the
demographic catastrophe.
The Government of Saint-Petersburg (letter ¹04/1820 dated March 15, 2004)
replied that the “…remarks and proposals will be taken into account while
developing and making managerial decisions”. However the government of the
Leningradskaya Oblast refused to observe the Constitution and Federal Laws
provisions on regulating the market (¹01-240 dated April 9, 2004) and
explained: “The concept of restoring and development of the Leningradskaya
Oblast agro-industrial complex presented in the letter presumes changing the
economic order in the Russian Federation, i.e. transfer from market economy to
an administrative-planned economy model. That is why essentially the proposals
do not fit the legal framework”.
Having examined the Government conclusions as well as the “Proposals”, the
“Open letter”, the above mentioned domestic and foreign programs, the Presidium
PROVIDES:
1. Recognize the Leningradskaya Oblast Government opinion that stopping the
introduction of a free market economy and transfer to a regulated market model
- as was done by all developed countries of the world - allegedly “…presumes a
change of the economic order in the RF” as false.
2. Note that as a result of transfer to a free market model on the lines of the
USA program “Strategy of reforms in the food and agricultural sectors of the
economy…Program of measures for the transfer period” founded on the
“Privatization of land and reorganization of agricultural enterprises in
Russia: the city of Nizhniy Novgorod model” the economic loss from production
reduction in the LO agricultural enterprises alone reached 10 bln. dollars US,
consumption of food in Saint-Petersburg and LO dropped below the
physiologically acceptable level, the loss in population exceeded half a
million people.
3. With account of the decision by V.Putin, President of the RF to join the
WTO, ask the Governors of Saint-Petersburg and the LO to urgently transfer to a
regulated market with the purpose of unifying the RF legal framework with that
of developed countries, provide for the coordination and acceptance of regional
laws “On state regulation of agro-industrial production in Saint-Petersburg and
the Leningradskaya Oblast” for the introduction in compliance with the RF
Constitution (art.76, par.2) of corresponding norms of Federal Laws on the
territory of the region. With the purpose of executing the RF Constitution
(art.72, par.1,o) provide for the creation of special Government structural
divisions in Saint-Petersburg and LO for carrying out negotiations with the
WTO, execution of decisions on regulating the market.
4. Approve the “Expert Opinion” of the experts’ working team on the
consequences of implementing a free market model by the Government of the LO
and the refusal to observe the RF Federal Laws on regulating the agro-food
market as well as on estimating the efficiency of reforming the LO agricultural
enterprises into family peasant farms, collective farming economies and
personal subsidiary plots along the US Nizhniy Novgorod model. Submit the
“Expert opinion” to the President’s Authorized Representative in the North-West
Federal Okryug, Governors of Saint-Petersburg and LO as well as to other
interested parties with a repeated request to urgently adopt Russian
Legislation on regulating the market.
5. Ask the Saint-Petersburg State Legislative Assembly deputies to create an
independent parliamentary commission of leading scientists and specialists,
representatives of public organizations and political parties, representing
major social-economic groups of the population for:
- assessment of the consequences of implementing the US “Strategy” as well as
“Proposals” on restoring production and consumption by the population of
foodstuff meeting the medical norms;
- preparation and adoption of legislative provisions for overcoming the
demographic catastrophe.
6. Ask the Leningradskaya Oblast Legislative Assembly deputies to set up an
independent parliamentary commission on assessing the consequences of
realization of:
- the US program “Privatization of land and reorganization of agricultural
enterprises in Russia: the Nizhniy Novgorod Model” (dissolution of agricultural
enterprises, voucher privatization of their land and property, planned
liquidation of one third of the LO agricultural enterprises);
- the IMF program “Provision of employment and increasing the income of
agricultural population” (creation by the experts of British “Know How”
foundation and the VIAPI in the Lodeinopolskiy, Boksitogorskiy and Tikhvinskiy
regions of collective farmer economies and personal subsidiary economies for
the employees of agricultural enterprises bankrupted by them);
- “Proposals on the restoration of goods production in insolvent agricultural
enterprises of the LO”.
As well as the preparation of required legislative provisions on overcoming the
demographic catastrophe.
7. Taking into account the numerous and inefficient appeals of agricultural
producers, trade unions and scientists to the President, Government, Federal
Assembly, Chairman of the Constitutional court, the RF General Prosecutor and
their bodies in the regions on stopping the introduction of the USA and EC
destructive programs and the necessity of observing the Constitution and the
Federal Law of the RF:
7.1. Inform the UN, international civil rights protection organizations that
the IMF experts and their co-executives in the RF Government are implementing
in Russia a US program “Strategy of reforms in the food and agricultural
sectors of economy… Program of measures for the transition period” following
which the plough land productivity is reduced by one fourth, agricultural
production is cut down two times.
By food consumption in terms of calories Russia dropped down from the top ten
(7th place) of the most well fed nations of the world with 3380 kcal. to the
seventh dozen with 2200 kcal. which is below the physiologically acceptable
level. The Russian Federation, which previously increased its population by 1
mln. people per year (Russia – by 2 mln.) is now losing its population at a
rate of 1 (one) mln. people per year. The human loss since 1989 according to
the official data of the State Statistics Committee (www.gks.ru) reached 10
mln. people in the RF alone. There are facts of sharp decline in the production
and consumption of food, reduction in the number of population representing
genocide which need to be assessed according to provisions envisaged in such
cases by the world community (the UN General Assembly resolution ¹260À dated
December 9, 1948).
7.2. The “Strategy” and the USA Nizhniy Novgorod model is seen by scientists as
a well substantiated and carefully coordinated program of mutual activities of
the IMF experts and their co-executors in the RF Government (in conformity with
the “Letter of Intent” dated 1992) on the destruction of production, the human
environment and extinction of the population. Their implementation in Russia is
seen as an act of economic terrorism of the USA, the EC against the
multinational population of Russia.
7.3. Practical implementation in Russia of the USA programs became possible and
is realized on the basis of a criminal, corruption plot of the USA, EC and
Russian leaders by a fraudulent way of agreements and are viewed as a capital
crime.
7.4. Ask the UN and international civil rights protection organizations to
begin procedures on stopping genocide in Russia, envisioned by the “Convention
on preventing the crime of genocide and punishment for it” and “Convention on
non application of a limitation period to war crimes and crimes against
humanity” and to oblige the IMF, the Government of the USA and EC to reimburse
the damage inflicted to agricultural enterprises, their employees and
population of the RF.
8. Ask the State Duma Deputies to:
8.1. Submit a deputy inquiry to the RF President as to on what grounds was
external management of the Russian economy introduced (“Letter of Intent” with
the IMF) and why are the Government of the RF and its bodies in the regions
implementing the “Strategy of reforms in the food and agricultural sectors of
the economy…” as well as the US Nizhniy Novgorod model;
8.2. Arrange parliamentary hearings on the assessment of the implementation in
Russia by IMF experts and their co-executors in the RF of the above mentioned
USA programs, the expediency of paying state debt to them for the development
and realization of the “transition period” programs and lay claims for the
reimbursement of damage inflicted to agricultural enterprises, their employees
and the population of Russia.
